Terms of Purchase
The terms that apply when you buy an artwork from Aldo Castillo Gallery.

About these terms
These Terms of Purchase apply when you buy an artwork from Aldo Castillo Gallery (“the gallery,” “we,” “us”), 634 5th Avenue South, Naples, Florida 34102, whether you buy on our website, by invoice, by telephone or email, at the gallery or at an art fair. Our Shipping Policy and Returns & Refunds Policy form part of these terms. Our Privacy Policy explains how we handle your information.
When you place an order on our website, you confirm that you have read and agree to these terms, and we record the version you accepted with your order. If you and the gallery sign a separate written agreement for a particular purchase, that agreement governs where it differs from these terms.
You must be at least 18 years old to buy from the gallery. Nothing in these terms limits any right you have under law that cannot be waived or limited by agreement, or your right to dispute a charge with your card issuer or bank.
Artwork descriptions
We describe each artwork carefully and in good faith, including the artist, title, date, medium, dimensions, edition and condition, as far as they are known to us. Dimensions are approximate. If a description does not say whether a frame, base or mount is included, please ask us before you buy.
Photographs and screens cannot reproduce color, texture, scale and surface exactly. Handmade works, including glass, ceramics and mixed media, vary naturally, and these variations are part of the work rather than defects.
Unless the description says otherwise, an artwork that is not new may show minor signs of age, handling or display consistent with its age and medium. We are glad to provide a condition report and additional photographs before you buy.
Where a description names an artist without qualification, the artwork is by that artist. “Attributed to” an artist means a work of the artist’s period that we believe is by the artist, with less certainty. “School of” an artist means a work by a pupil or close follower of the artist.
If we find an error in a description, we will correct it and tell you. If you have already paid, you may choose to continue with the purchase or cancel it for a full refund.
Authenticity
The gallery guarantees that each artwork is by the artist named in its description, as qualified by any of the terms above. If it is established that an artwork is not, we will refund the full price you paid, including tax and shipping, when you return the artwork to us with good title and in the condition in which it was delivered. This guarantee is in addition to your rights under Florida law and the law of any other state that applies to your purchase. Where the artist or publisher provides a certificate of authenticity, we deliver it with the artwork.
Consigned works
Some works of art are being sold subject to a contract of consignment.
Prints, photographs, sculpture casts and other editions
For works made in editions, we tell you in the description or in writing, as far as the information is known: the size of the edition and the number of your impression, whether and how the work is signed, the medium and process, whether it is a reproduction, the year it was made, and whether proofs or other impressions exist outside the numbered edition. Ask us if any of these details is missing.
California and New York law require written disclosures for prints, photographs and sculpture casts sold into those states. If you ask, we send them to you before you pay or place your order. Otherwise we supply them with delivery, and if you then return the work for a reason related to that information within 30 days of receiving it, in the condition in which you received it, we refund your purchase.
Prices and taxes
Prices are in US dollars and are for the artwork only. Shipping, crating and taxes are shown separately at checkout or on your invoice.
Where a price is confirmed privately, or where the gallery accepts your offer, the price is the one shown on your invoice.
Florida sales tax applies to artworks delivered in Florida and to artworks you collect or take from the gallery. Artworks we deliver to a carrier for shipment outside Florida are not subject to Florida sales tax. Other states may require us to collect their sales tax; otherwise you may owe use tax to your state. For international deliveries, import duties, taxes and customs charges are your responsibility unless your invoice says otherwise.
If we find an obvious error in a price, we will tell you, and you may choose to buy at the correct price or cancel for a full refund.
Placing an order
An artwork with a complete price, including its shipping, can be bought immediately. An artwork that needs custom crating or freight is bought with a purchase request: you see the artwork price and any tax, and the gallery then quotes crating and shipping.
Adding an artwork to your selection or cart does not reserve it. When you place an order, we reserve the artwork for you and send you an invoice. A contract of sale forms when we receive your payment, or your deposit for a purchase request. Until then, either of us may cancel the order without charge.
We may decline an order, or cancel it and refund everything you have paid, if the artwork is no longer available, if a price or description is wrong, if we cannot deliver to your address, or if we reasonably suspect fraud or an unauthorized payment.
If you make an offer, the gallery may accept, decline or counter it. An offer is accepted only when we confirm it in writing, and the accepted price is then payable as stated on your invoice. A hold arranged with the gallery is not a sale unless a deposit plan is agreed on your invoice.
Payment
We accept ACH bank transfer, check, wire transfer, and credit or debit card. The gallery prefers ACH, check or wire, and adds no fee for paying by card. Online card and bank payments are processed by Stripe.
Pay the amount shown on your invoice by its due date. An artwork bought immediately is paid in full at checkout. A balance invoice for a purchase request is due within 10 business days of the date we issue it. If an invoice is not paid on time, we may cancel the order and release the artwork after letting you know, subject to the deposit terms below.
When you pay by ACH bank transfer on your payment page, you authorize the gallery to debit your bank account once, for the amount shown, under the authorization displayed on that page. The gallery emails you when your payment is submitted and again when it clears. To cancel the authorization, contact us before the debit is made. ACH payments usually take several business days to clear, and checks can take longer. We ship an artwork only after your payment has cleared in full.
Send wires and checks only to the payment details shown on your invoice or secure payment page. If you receive a message with different payment details, do not send payment until you have confirmed them with the gallery directly.
Ownership of the artwork passes to you when we receive full payment in cleared funds. If a payment is reversed or fails, the amount becomes due again. Please contact us first if there is a problem with a charge, so we can help.
Deposits
When you submit a purchase request online, you pay a deposit of 50 percent of the artwork price, which reserves the work for you. A deposit never includes shipping or tax. Once we have quoted crating and shipping, we issue a balance invoice for the artwork price, crating, shipping and any tax, less your deposit. The gallery may also agree to hold an artwork for you against a deposit, with the balance due on the date shown on your invoice.
Your deposit reserves the artwork and withdraws it from sale. Before you pay a deposit online, we ask you to accept these deposit terms separately:
You may cancel for a full refund of your deposit within three business days after paying it, or until three business days after the gallery sends your crating and shipping quote, whichever is later. After that, a deposit paid by card is non-refundable if you cancel or do not pay the balance by its due date. A deposit paid by ACH bank transfer, check or wire stays refundable until you pay the balance.
Any deposit, including a card deposit, is refunded in full at any time if the gallery cancels the order for a reason that is not your fault, if the artwork is lost or damaged before delivery, if it is materially different from its description, if we cannot ship it within the time we promised and you choose to cancel, or if the law requires a refund. If you would rather not accept our shipping quote, you may instead collect the artwork from the gallery or have your own insured fine art shipper collect it.
Cancelling an order
- Before you pay: you may cancel an unpaid order or purchase request at any time by contacting us, at no charge.
- After a deposit: the deposit terms above apply.
- After you pay in full: the sale is final, except as our Returns & Refunds Policy provides. The gallery may agree in writing to cancel before the artwork ships.
- Art fairs and other temporary locations: if you buy an artwork for $130 or more away from the gallery, for example at an art fair, you may cancel within three business days, as explained in the cancellation notice we give you at the time of sale.
Shipping, collection and risk
Our Shipping Policy explains shipping options, timing and collection from the gallery. The gallery is responsible for loss of or damage to the artwork until it is delivered to your shipping address or collected by you or your shipper.
Copyright
Buying an artwork gives you ownership of the physical work. Copyright in the work, including the right to reproduce it, remains with the artist or the artist’s estate unless they transfer it to you in writing. You may photograph the artwork for your own records and insurance.
Our responsibility to you
The gallery promises that it has the right to sell each artwork and that the artwork will be free of any claim or lien when you have paid in full. The gallery does not promise that an artwork will keep or increase its value.
To the extent the law allows, the gallery’s total liability for any claim about a purchase is limited to the amount you paid for it, and the gallery is not liable for indirect or consequential losses, such as loss of anticipated profit or appreciation. These limits do not apply to personal injury, to fraud, or where the law does not allow them.
Electronic records
You agree that we may provide invoices, receipts, notices and these terms electronically, by email or on your order page, and that your acceptance at checkout has the same effect as a signature. To view them you need an internet connection, an email account and software that opens PDF files. You may ask us for a paper copy of any invoice or notice at no charge, or withdraw your consent to electronic records by writing to us, and we will then send future records by mail.
Governing law and disputes
Florida law governs these terms and your purchase. If you have a concern, please contact us first; most concerns can be resolved quickly.
Any lawsuit about a purchase must be brought in the state or federal courts serving Collier County, Florida, except that either of us may bring a claim in small claims court, and you may bring a claim in the courts where you live if the law of your state gives you that right.
Changes and contact
We may update these terms. The version in effect when you place your order applies to that order, and the effective date above shows when these terms last changed.
